On the "group of companies doctrine" and interpreting the subjective scope of arbitration agreements: which law applies?

Abstract: This article sets out the facts of the case decided by the German Federal Supreme Court and the Higher Regional Court Braunschweig involving the group of companies doctrine. It also analyses which law applies to determining the subjective scope of arbitration agreements and concludes with a résumé on the questions raised. For the purpose of this article, it is assumed that the subjective scope of international arbitration agreements must be determined by the provisions of a specific legal system.
