Arbitration in the Netherlands: the 2015 Dutch arbitration act

Abstract: The Netherlands is an arbitration-friendly jurisdiction and arbitration has long been recognised and supported as the most important method of alternative dispute resolution. On 01.01.2015, a new arbitration act came into force. The revised Dutch Arbitration Act 2015 codifies best practices in international arbitration law, maximises party autonomy, reduces the administrative burden in arbitral proceedings and provides for a more sophisticated framework for ad hoc proceedings. Changes that are of particular interest in the international context include (i) that the involvement of state courts is even more limited than under the previous Arbitration Act 1986; (ii) that setting-aside proceedings have been shortened; and (iii) that the jurisdiction of state courts only revives if an arbitral tribunal declares itself incompetent or sets aside an award because of the absence of a valid arbitration agreement. This article deals with the changes brought about as a result of the Arbitration Act 2015, which changes will secure and further improve the reputation of the Netherlands as a “go to” arbitration state.
