A contribuição da América Latina para o desenvolvimento da arbitragem comercial internacional
Descrição
Abstract: The very first contribution of the Latin American arbitral law to international commercial arbitration is its existence not only in theory, but also in actual practice. In a very short period of time, legislations have been modernized, including by ratification of the New York Convention, and there has been a consolidation of a positive case law, at the same time as the numbers of arbitration cases and arbitrators have been truly increased. In addition, the bibliography on the subject of arbitration, as well as seminars and conferences in Latin America (international and national), has also increased. Especially in Brazilian practice, it is possible to identify such important cases - true leading cases -, a plenty of well drafted arbitral awards and judicial decisions, as icons of how arbitration has improved in the region, besides the ethics and social concerns that lead arbitrators and professionals to further the binding effect of contract among other human relevant values.
