Access to justice or access to states courts’ justice in Europe? The directive 2008/52/EC on civil and commercial mediation

Abstract: In this article, the author deals with a very important question that is: access to Justice is the same as access to State Court's Justice? He concludes in the sense that nowadays there is a broader understanding of the principle of access to justice. Mediation is the preferred ADR in Europe and this is the main topic of this text. The author studies this subject mainly according to the European Directive 2008/52 on Civil and Commercial mediation.
