Beyond the law: equity?

The Italian positive Law, in the Civil Code and Code of Civil Procedure, mentions equity several times. The problem is to define the meaning of this word. In arbitration equity can cause surprises. It is preferable, from the point of view of legal certainty and predictability, to employ the positive Law.
