What is the point of winning a claim if the final judgment will be ineffectual? We can think about many examples to enlighten the purpose of a relief. Let’s think about a vessel discharging at a foreign port. The vessel is owned by a company whose only asset is the vessel. The ship is intended to leave the port without paying for custom and port authority rights. So, should she actually leave the port without paying, the Custom and Port authority will have a legitimate right to claim for payment, whether before the judiciary or arbitration. However, even if they win, how to collect if the vessel departed and no owner’s assets are traceable for enforcement? Well, one of the options to avoid an ineffectual verdict is to ask for a precautionary measure to the Court before the vessel leaves: an arrest of the ship, which will prevent the vessel to escape the port until a final decision is made. Hence, should the port and custom authority win the trial, the vessel could be enforced and sold in the local market."
